Fisker Ocean One Preorder Agreement

@seancallahan I was wondering if delaying the lock-in date and the actual delivery date may be seen by some as a breach of contract. We were first given a precise lock date then it was switched to Q1 and now it looks like the actual delivery will take place in Q2

@mike-fisker After re-reading the agreement, if customers are unhappy for whatever reason, the best thing is to follow what is listed under section #14.

Well, you can "resell" your One after you have fully paid for it.  Once you have the title of the car, you can do................................

@mike-fisker I had to end up buying my Acura lease as it was up on 12/31/22. Thought We would have our Ocean Ones in Q4 2022. The delay has caused hardship. Potentially a breach of contract?

Here is the language from the "Fisker Ocean One Preorder Agreement Terms and Conditions":

8. Delivery. We will notify you when your Fisker Ocean One becomes available for delivery.  We may deliver Fisker Ocean One vehicles in order of approximate reservation date, but delivery will also be affected by the manufacturing schedule and the roll out timing for your delivery area. We expect deliveries of Fisker Ocean One to commence in November 2022 with delivery time of your Fisker Ocean One dependent upon manufacturing schedule as well as timing for commencement of deliveries in your region. We cannot guaranty the delivery date of your Fisker Ocean One but will endeavor to conclude deliveries of all Fisker Ocean Ones by September 30, 2023. Fisker Ocean One orders for your region will be delivered prior to any Fisker Ocean Extreme, Ultra or Sport variants in your region. Any estimated delivery date of your Fisker Ocean One, if provided, is only an estimate and not a guaranty.

Any timing they have provided to date has been estimates and they have so far only announced Lock Dates.  They have provided delivery estimates to only a handful of people (and believe they may only be in Europe as well).  Even if they could build all the Ones on 11/17/22; delivery to the U.S. in Q4 of last year would have been impossible unless you were assuming the cars were being air shipped to the U.S.  The only date they are "committing" to is 9/30/23 and even that date they are only committing to "try hard" to achieve.
